In this regard, the main question of the present article is what are the competent authorities in the process of expropriation in the law of Iran and France and what is the process of expropriation in these two countries in terms of public interest? The results of the present study indicate that in France, expropriation operations are carried out by dual administrative and judicial institutions in two stages: administrative and judicial. The administrative authorities begin it, and the judges and the special judge of judicial possessions end it by issuing a transfer of ownership and an order to pay compensation. But in the Iranian legal system, the powers of the executive branch are vast and the role of the judiciary is limited, and the expropriation judge in the Iranian judicial system is unknown. However, the intervention of the prosecutor as the guardian of the public interest in the stage of transfer of property is mandatory. In addition, in the process of acquiring property in Iran, unlike in France, right holders do not have the opportunity to object or request an appeal regarding the method of approving the plan and its content.}, keywords = {Property Rights,Expropriation,public interest,Challenges}, title_fa = {تأملی بر مراجع صلاحیت دار و آیین شکلی سلب مالکیت اراضی در حقوق ایران و فرانسه}, abstract_fa = {در نظام‌های حقوقی مدرن، دولت از قدرت تملک اراضی به منظور تامین بخشی از اهداف عمومی برخوردار است و قوانین، دامنه اختیارات مراجع دولتی را به منظور تامین حقوق مالکانه تعیین می‌کنند. در این راستا سوال اصلی مقاله پیش‌رو این است که مراجع صلاحیت دار در فرآیند سلب مالکیت در حقوق ایران و فرانسه کدامند و روند سلب مالکیت در در این دو کشور با لحاظ منافع عمومی به چه ترتیبی است؟ نتایج پژوهش حاضر حاکی از آن است که در فرانسه عملیات سلب مالکیت توسط نهادهای دوگانه اداری و قضایی و طی دو مرحله اداری و قضایی انجام می شود. مقامات اداری آنرا آغاز و دادرسان و قاضی ویژه تملکات دادگستری با صدور قرار انتقال مالکیت و حکم به پرداخت غرامت به آن پایان می‌دهند. اما در نظام حقوقی ایران اختیارات دستگاه‌های اجرایی وسیع و نقش دادگستری محدود می‌باشد و قاضی سلب مالکیت در نظام قضایی ایران ناشناخته است. با اینحال مداخله دادستان بعنوان حافظ منافع عمومی در مرحله انتقال املاک اجباری می‌باشد. به علاوه در فرایند تملک املاک در ایران، برخلاف فرانسه صاحبان حقوق در مورد شیوه تصویب طرح و محتوای آن، امکان اعتراض یا تقاضای تجدیدنظر ندارند و تصویب طرح‌های عمومی و عمرانی بدون مشارکت عمومی و کسب نظر از مالکانی صورت پذیرد که از طرح متاثر می‌شوند.}, keywords_fa = {حق مالکیت,سلب مالکیت,منافع عمومی,چالشها}, url = {https://www.malr.ir/article_246373.html}, eprint = {https://www.malr.ir/article_246373_4e9a57d366a04c85ca3e73a59438b7d4.pdf} }
