It affected the individual and collective life of man and led to the emergence of modern law, of which the principles of fair trial are a product. Hence, the main question of this article is about the relationship between having the author elements of modernity and aspects of the legal system. For this purpose, it is necessary to first identify the objective and epistemological / value elements of the phenomenon of modernity as well as the four legal aspects, namely the "purpose" and "source" of law, the legal "method" and the "reference" of legislation. Iran and the United Kingdom and the relationship between these elements and their legal systems were studied using a comparative method and qualitative analysis.The findings of the study indicate the fact that the United Kingdom, due to the presence of most elements of new life (modernity), has a modern legal system and as a result; In the realm of principles and guarantees, the procedural rights of the accused employee are more developed, and the exercise of these rights is documented in human rights documents. In contrast, Iran lacks all the elements of modern law due to its maximum elements of modern life, and therefore, at present, it does not have the principles and guarantees of a complete and developed procedure in accordance with human rights documents.}, keywords = {Modernity,Legal System,modern law,Fair Trial}, title_fa = {وضعیت عناصر مؤلف مدرنیته و نسبت میان آنها و نظام حقوقی در ایران و انگلستان}, abstract_fa = {مدرنیته که در برگیرنده عناصر عینی (دولت ملی و جامعه متکثر) و ذهنی/ ارزشی (عقل خودبنیاد و حق) است، بر بستر خاص تحولات سیاسی و فکری اواخر قرون وسطی و عصر رنسانس و پس از آن شکل گرفت و تکامل یافت و تمامی مظاهر زندگی فردی و جمعی آدمی را تحت تأثیر قرار داد و به ظهور حقوق مدرن - که اصول دادرسی عادلانه از جمله محصول آن است- انجامید. از اینرو، پرسش اصلی این مقاله در باب نسبت میان برخورداری از عناصر مؤلف مدرنیته و جهات نظام حقوقی است. برای این منظور، ناگزیر، بدواً عناصر عینی و معرفتی/ ارزشی بروز پدیده مدرنیته و نیز جهات چهارگانه حقوقی، یعنی "هدف" و "منبع" قانون، "روش" حقوقی و "مرجع" قانونگذاری شناسایی و سپس، وضعیت عناصر مؤلف مدرنیته در ایران و انگلستان و نسبت این عناصر با نظام حقوقی آنها، با استفاده از روش مقایسه‌ای مورد بررسی و تحلیل کیفی قرار گرفت. یافته‌های پژوهش گویای این واقعیت است که کشور انگلستان، به دلیل وجود اغلبی عناصر حیات نو (مدرنیته)، دارای نظام حقوقی مدرن می‌باشد و نتیجتاً؛ در قلمرو اصول و تضمینات حق‌های رویه‌ای کارمند متهم، توسعه‌یافته‌تر است و اعمال این حق‌ها مستند به اسناد حقوق بشر رویه‌ای صورت می‌گیرد. در مقابل، ایران به دلیل دارانبودن حداکثری عناصر حیات مدرن فاقد همه اجزای مؤلف حقوق مدرن می‌باشد و لذا در حال حاضر، از اصول و تضمینات رویه‌ای کامل و توسعه‌یافته منطبق بر اسناد حقوق بشر رویه‌ای برخوردار نیست.}, keywords_fa = {مدرنیته,نظام حقوقی,حقوق مدرن,دادرسی عادلانه}, url = {https://www.malr.ir/article_247999.html}, eprint = {https://www.malr.ir/article_247999_7416a1bf1215b2585779ae7680ae5eca.pdf} }
