The long duration of construction projects and fluctuations in the prices of materials, especially due to today's unstable economic conditions, is one of the important reasons for the many differences and obstacles in the development of pre-sale contracts in Iran. Regardless of the circumstances beyond the control of the parties, many contractual and non-contractual issues, due to the multidimensional complexity of pre-sale contracts, cause the parties to differ in fulfilling the obligations of such contracts. In this study, the factors that cause differences in real estate contracts (in general) and pre-sale contracts (in particular) are investigated. The government and especially the document registration organization can reduce the number of lawsuits in this area by applying appropriate regulations in various areas such as pre-sale registration, adequate awareness, and implementation of the cadastral plan. Radameh also offers solutions to prevent disputes in building pre-sale contracts, which seems to be one of the most important solutions for the official registration of building pre-sale contracts. In general, in this study, regardless of the type and nature of pre-sale contracts, in a descriptive-analytical manner to identify the causes of disputes with the origin of the administrative system and ways to prevent these disputes from the perspective of administrative law.}, keywords = {Registration proceedings,Regulation,Pre-sale,Cadastre,Ownership}, title_fa = {راهکارهای اداری کاهش دعاوی ناشی از قراردادهای پیش فروش ساختمان در پرتو نقش تنظیم‌گری دولت}, abstract_fa = {امروزه اختلافات در فروش ساختمان و واحدهای آپارتمانی قبل از ساخت یکی از معضلات رایج در جامعه است که بستگی به قراردادهای پیش فروش یا پیش ساخت دارد. طولانی بودن مدت پروژه های عمرانی و نوسانات قیمت مواد و مصالح به ویژه با توجه به شرایط بی ثبات اقتصادی امروز یکی از دلایل مهم اختلافات فراوان و مانعی در توسعه قراردادهای پیش فروش در ایران است. بدون در نظر گرفتن شرایط خارج از اراده طرفین، موضوعات قراردادی و غیر قراردادی بسیاری با توجه به پیچیدگی چند بعدی بودن قراردادهای پیش فروش، موجب اختلاف طرفین در انجام تعهدات چنین قراردادهایی است. در این پژوهش عواملی که موجب بروز اختلاف در قراردادهای مربوط به اموال غیرمنقول(به طور عام) و قراردادهای پیش فروش(به طور خاص) می گردد، بررسی می شود. دولت و به ویژه سازمان ثبت اسناد با اعمال تنظیم گری مناسب در حوزههای محتلف از جمله ثبت پیش فروش، آگاهی رسانی کافی، پیاده سازی طرح کاداستر میتوانند موجب کاهش دعاوی در این حوزه گردند. د رادامه همچنین راهکارهایی جهت جلوگیری از وقوع اختلاف در قراردادهای پیش فروش ساختمان ارائه گردیده است که به نظر می رسد ثبت رسمی قراردادهای پیش فروش ساختمان یکی از مهم ترین راهکارها می باشد. به طور کلی در این پژوهش، صرف نظر از نوع و ماهیت قراردادهای پیش فروش، به صورت توصیفی-تحلیلی به شناسایی عوامل بروز اختلاف با منشا نظام اداری و راه های جلوگیری از این اختلافات از منظر حقوق اداری پرداخته شده است.}, keywords_fa = {دادرسی ثبتی,تنظیم گری,پیش فروش,کاداستر,مالکیت}, url = {https://www.malr.ir/article_253184.html}, eprint = {https://www.malr.ir/article_253184_6055e6869984c7ecb1955231b068b27e.pdf} }
