Historically, Principle of legitimate expectations in administrative law has been regarded as a distinctive protective principle for protecting citizens against government and administrative authorities. Legitimate expectations in administrative law is not a consistent theory, but primarily is the product of judicial precedent. But as long as is concerned to England, this principle like other overview principles is a judicial reaction to discretionary powers of administration and (unlike Germany and EU) has been applied in various situations. This makes this principle not only in conflict with other principles but makes it difficult to find a distinctive justification for applying it. This article with a descriptive method tries to approach to and recognize legitimate expectation in negative way: from trying to find and recognize a separate justifying base for legitimate expectations in legal doctrine and judicial precedent especially in England to recognition of distinctions to discern interior elements of the principle (legitimate expectations from reasonable expectations, legitimate expectations from legally enforceable rights and interests, legitimate expectations and contractual expectations, emphasis on internalist approach to legitimacy in contradiction with externalist approach to legitimacy and lastly, recognition of legitimate expectations as an enforceable interest in public law) in order to prevent some possible misunderstandings to comprehend this comparably new found principle in our legal literature.}, keywords = {Legitimate Expectations,reasonable expectations,Legal Certainty,administrative law}, title_fa = {وجوه متمایز اصل انتظارهای مشروع در حقوق اداری}, abstract_fa = {انتظارهای عمومی از دولت با آنچه اصل انتظارهای مشروع در حقوق اداری خوانده می شود، متفاوت است. اصل انتظارهای مشروع در حقوق اداری از نظر تاریخی، بعنوان یک اصل حمایتی «مستقل»، برای حمایت از شهروندان در برابر اختیارات دولت و مقامات عمومی مطرح گردید. اصل انتظارهای مشروع یک نظریه منسجم در حقوق اداری نیست؛ بلکه ابتدائا محصول رویه قضایی کشورهای مختلف است. اما تا جاییکه به انگلستان مربوط می شود، این اصل همانند سایر اصول نظارتی واکنشی قضایی به اختیارات اداره است که (برخلاف آلمان و اتحادیه اروپا) در وضعیت های متنوعی بکار گرفته شده است و همین امر علاوه بر ایجاد تزاحم با سایر اصول نظارتی، تشخیص مبنای ارزشی متمایز برای آن را دشوار کرده است. این مقاله به شیوه ای تحلیلی- توصیفی، در پی شناخت بهتر اصل انتظارهای مشروع به شیوه ای عمدتا سلبی است. از تلاش برای یافتن و تشخیص مبنایی «متمایز» برای انتظارهای مشروع در رویه و دکترین بویژه در انگلستان تا شناسایی تفکیک و تمایزاتی در درون این اصل؛ تمایز بین انتظار مشروع و انتظار معقول، بین انتظار مشروع از انتظارهای قانونی، بین انتظار مشروع و انتظارهای قراردادی؛ همینطور تاکید بر مشروعیت درونی انتظار و تمایز آن از معیارهای بیرونی مشروعیت و در نهایت، تمیز انتظار مشروع بعنوان یک «نفع» قابل شناسایی در حقوق عمومی. تاکید بر این تمایزات می تواند از برخی سوء تفاهم های احتمالی در فهم این اصل نه چندان با سابقه در ادبیات حقوقی ما جلوگیری کند.}, keywords_fa = {انتظارهای مشروع,اطمینان حقوقی,انتظارهای قانونی,حقوق اداری}, url = {https://www.malr.ir/article_255069.html}, eprint = {https://www.malr.ir/article_255069_4f85e1437b771bdb59e84b6f9048b253.pdf} }
