One of the stages of the manifestation of human rights in administrative law is recruitment and entry into government service. In entering service and employment, it is necessary to observe principles such as equality, justice and respect for human dignity. Basic laws as well as ordinary laws have considered general and specific conditions for entering the service. As long as the mentioned conditions are in accordance with the principles of human rights, there will be no problem, but sometimes it is observed that the legislators consider criteria and conditions in the recruitment and selection stage that conflict with the principles of equality, justice and competence. is placed In Iran's legal system, the regulations related to employment are included in the civil service management law and the country's selection law. The study of the said laws shows that although in the civil service management law, the legislator has tried to approach the standards of human rights, but the inclusion of some criteria in the selection law is not consistent with the said principles and deserves criticism.}, keywords = {Administrativelaw,Human Right,Administrativeright,employment}, title_fa = {نقد معیارهای ورود به خدمت و گزینش در حقوق اداری ایران در پرتوی موازین حقوق بشری}, abstract_fa = {امروزه، حقوق بشر به گفتمانی جهانی تبدیل شده است به گونه‌ای که رشته‌های مختلف حقوقی تحت تاثیر حقوق بشر قرار دارند. در این میان، حقوق اداری نیز از این تاثیر بی بهره نماینده به گونه‌ای که در دنیای امروز سخن از حقوق بشر اداری به میان آمده است. منظور از حقوق بشر اداری، حقوقی اداری است که به موازین و معیارهای حقوق بشری پایبند و ملزم می-باشد. یکی از مراحل نمود حقوق بشر در حقوق اداری، استخدام و ورود به خدمت دولت است. در ورود به خدمت و استخدام، رعایت اصولی مانند برابری، عدالت و رعایت کرامت انسانی ضروری است. قوانین اساسی و نیز قوانین عادی، شرایط عمومی و اختصاصی را برای ورود به خدمت در نظر گرفته‌اند. مادامی که شرایط مزبور منطبق با اصول حقوق بشری باشند، مسئله‌ای بروز نخواهد کرد اما گاه مشاهده می‌شود، قانونگذاران، در مرحله جذب و گزینش معیارها و شرایطی را در نظر می‌گیرند که با اصول برابری، عدالت و شایستگی در تعارض قرار می‌گیرد. در نظام حقوقی ایران، مقررات مربوط به استخدام در قانون مدیریت خدمات کشوری و نیز قانون گزینش کشور احصاء شده است. مطالعه قوانین مزبور نشان می‌دهد گرچه در قانون مدیریت خدمات کشوری، قانونگذار تلاش نموده تا به معیارهای حقوق بشری نزدیک گردد اما در قانون گزینش درج برخی معیارها، با اصول مزبور همخوانی نداشته و شایسته نقد است. روش تحقیق در این پژوهش از نوع توصیفی-تحلیلی است و در گردآوری منابع از روش کتابخانه‌ای استفاده شده است.}, keywords_fa = {حقوق بشر,حقوق اداری,ورود به خدمت,استخدام,کرامت انسانی}, url = {https://www.malr.ir/article_255073.html}, eprint = {} }
