بررسی تاثیر کرونا بر حق دسترسی به عدالت؛ مطالعه موردی تطبیقی

چکیده

حق دسترسی به عدالت، یک حق اساسی و از اصول بنیادین دادرسی ها و در نوع خودش یک ابزار لازم برای حمایت از سایر حقوق است. شرایط بی‌سابقه کووید-19 مجموعه وسیعی از محدودیت‌ها را بر حقوق ضروری مردم از جمله دسترسی آزاد، عادلانه و مؤثر به عدالت تحمیل کرده است.این پژوهش با هدف مطالعه نسبت به صیانت از این حق بشری با مداقه در نظام های حقوقی دیگر به روش توصیفی – تحلیلی و با گردآوری منابع به صورت کتابخانه ای در مقام پاسخ به این پرسش است که نظام های مختلف حقوقی، چه رویکردی را در صیانت از این حق در محاکم مختلف اتخاذ کرده اند. یافته های پژوهش حاکی از آن است که در نظام های حقوقی مورد بحث، حسب مورد این حق بدون تغییر نسبت به شرایط حاکم جریان داشته و در مواردی محدود شده یا در برخی موارد به طور موقت به تعلیق در آمده است اما به طور کلی نقض نشده و با وضع قوانین و مقررات و صدور دستورالعمل ها با استفاده از فناوری های نوین مجازی صیانت شده است و در مواردی که به دلیل ماهیت فوری دعاوی، استماع دعاوی از نظر دادگاه به صورت حضوری ضرورت داشت، این امر با رعایت فاصله های فیزیکی به منظور حفظ ایمنی و سلامت افراد به عنوان اولویت اصلی صورت می پذیرفت.

چکیده [English]

The right of access to justice is a basic right and one of the fundamental principles of proceedings and in its own way is a necessary tool to protect other rights. The unprecedented conditions of Covid-19 have imposed a wide range of restrictions on the essential rights of people, including free, fair and effective access to justice. This research aims to study the protection of this human right with a focus on other legal systems in a descriptive way. - Analytical and by collecting sources in the form of a library, it is an answer to the question of what approach different legal systems have adopted in protecting this right in different courts. The findings of the research indicate that in the discussed legal systems, depending on the case, this right has flowed without change compared to the prevailing conditions and in some cases it has been limited or in some cases it has been temporarily suspended, but in general it has not been violated. And it has been protected by establishing laws and regulations and issuing instructions using modern virtual technologies, and in cases where due to the urgent nature of the claims, it was necessary to hear the claims in person by the court, this is done by observing physical distances in order to Keeping the safety and health of people was the main priority.
