On the one hand, the government is constituted by popular consent. On the other hand, to be effective, such a power must be restricted by recourse to concepts, such as the rule of law (constitutionalism paradox). explaining the relationship between populism with any of the concepts of the rule of law and judicial oversight helps shed light on this paradox and the populist interpretation of constitutionalism. Examining the relationship between these two notions suggests that merely explaining the relationship between populism and the rule of law is not particularly productive and fails to eliminate this ambiguity. Instead, one must investigate the association between different conceptions of the rule of law with populism to illuminate the matter wholly. From this perspective, populism and the rule of law are not necessarily at variance. Instead, populism is solely in contradiction with a substantive reading of the rule of law, and formal interpretation of the rule of law can be consistent with populism. Analyzing the relationship between populism and the substantive conception of the rule of law demonstrates that populism does not realize the right of popular sovereignty, unlike the prevalent claims. Instead, it leads to the rule of the majority, not the people. the article concludes that the superiority of the substantive conception of the rule of law over populism in the legal and political system without taking account of the rights-based models of judicial oversight will not be helpful.}, keywords = {populism,Rule of law,Rule by Law,Formal Conception,Substantive Conception}, title_fa = {واکاوی نسبت میان حاکمیت قانون و پوپولیسم: سازگاری یا تقابل}, abstract_fa = {پوپولیسم در سالیان اخیر از دل این چالش نظری زاده شده است که از یک طرف حکومت تحت رضایت مردم تأسیس می‌شود و از طرف دیگر قدرت حکومت برای اثرگذاری و پایداری با توسل به مفاهیمی همانند حاکمیت قانون و نظارت قضایی باید منفک و محدود اعمال شود؛ چالشی که امروزه با عنوان «تناقض مشروطه‌گرایی» شناخته می‌شود. تبیین رابطه پوپولیسم با هر یک از مفاهیم حاکمیت قانون و نظارت قضایی در روشن شدن ابعاد این پارادوکس شناخت تفسیر پوپولیستی از مشروطه‌گرایی راهگشاست که در این مقاله این موضوع از منظر حاکمیت قانون تحلیل شده است. بررسی رابطه این دو مفهوم نشان می‌دهد صرف تبیین رابطه پوپولیسم و مفهوم حاکمیت قانون چندان دقیق نخواهد بود و ابعاد این ابهام را رفع نمی‌کند و برای روشن شدن تمام زوایا لازم است تا نسبت برداشت‌های مختلف از حاکمیت قانون با پوپولیسم مورد بررسی قرار گیرد. از این منظر رابطه پوپولیسم و حاکمیت قانون لزوماً مبتنی بر رابطه تباین نیست بلکه پوپولیسم صرفاً با برداشت ماهوی از حاکمیت قانون تباین دارد و سازگاری برداشت شکلی از حاکمیت قانون با پوپولیسم امری ممتنع نیست. با تحلیل رابطه پوپولیسم با برداشت ماهوی از حاکمیت قانون کاملاً مشخص می‌شود که پوپولیسم در نهایت بر خلاف ادعای حمایت از حق حاکمیت مردم، منجر به تحقق آن نمی‌گردد بلکه نتیجه‌اش برتری حاکمیت اکثریت است نه مردم و بر این مبنا تحلیل شد، غلبه برداشت ماهوی از حاکمیت قانون بر پوپولیسم در نظام حقوقی و سیاسی بدون توجه به الگوهای حق بنیان نظارت قضایی راه به جایی نخواهد برد.}, keywords_fa = {پوپولیسم,حاکمیت قانون,حکومت به وسیله قانون,برداشت شکلی,برداشت ماهوی}, url = {https://www.malr.ir/article_251247.html}, eprint = {https://www.malr.ir/article_251247_3ed255f4092373c19628e2e2859731a4.pdf} }
