The comparative study of this research illuminates that United Kingdom has conferred a huge discretion to local states and non-governmental institutes in order to protect above-mentioned right, although the central government plays still a pivotal role in making essential decisions. The reason is that in United Kingdom the publicity of cultural heritage and the public participation are accepted as two main principles, governing on the protection of cultural heritages. The result is an effective system of protection. On the other side, In Iran, since the protection of non-moveable cultural heritages is tied to sovereignty, ministry of cultural heritage tourism and handicrafts is regarded as an only authorized institute. Therefore, non-governmental and local institutes play a very small role in the process of the protection. It means that Iranian system of protection suffers lack of public participation and Specialization as a result of this restriction. In this research, beside of introducing British principles of protection of non-moveable cultural heritages and its comparison with Iranians one, the author tries to introduce extend of discretion of different institutes which protect these heritages in both countries.}, keywords = {Historic heritage,Cultural Heritage,Conservation of Cultural heritage,British law,Immovable cultural heritage}, title_fa = {حفاظت از میراث فرهنگی غیر منقول از منظر اصول و نهادهای موثر : مطالعه تطبیقی حقوق انگلیس و ایران}, abstract_fa = {این نوشتار تلاش می‌کند از حفاظت از میراث فرهنگی غیر منقول به عنوان یکی از حق‌های بشری سخن بگوید. حقی که در ساحت زندگی جمعی مطالبه می شود. مطالعه‌ی تطبیقی حقوق حفاظت از میراث فرهنگی غیر منقول در انگلیس و ایران نشان می دهد که اگر چه در انگلیس مسئولیت اصلی تصمیم‌گیری در حفاظت از میراث انگلیسی با نهادهای دولتی است، اما بخش عمومی، با به رسمیت شناختن نهادهای غیر دولتی متعدد و جوامع محلی، صلاحیتی گسترده یه آنان اعطا نموده است. شناسایی چنین صلاحیتی تبلور اصول عمومی بودن و مشارکت مردمی به عنوان دو اصل بنیادین حاکم بر نظام حفاظت از میراث فرهنگی انگلیس است که در نهایت یک نظام موثر را برای این کشور به ارمغان آورده است. این در حالی است که در ایران از آنجا که حفاظت از میراث فرهنگی جز امور حاکمیتی است، لذا وزارت میراث فرهنگی و ادارات تابع آن به عنوان متولی اصلی میراث میراث فرهنگی به‌طور متمرکز به مسأله حفاظت پرداخته و در مقایسه با کشور انگلیس نقش به مراتب کمتری را یرای جوامع محلی و سازمان‌های مردم نهاد قائل شده‌اند که این موضوع در نهایت نظام حفاظت موثر از میراث فرهنگی ایران را با خلاء عدم تنوع نهادی و در نتیجه فقدان تخصص‌گرایی و فقدان مشارکت مردمی مواجه می‌سازد. نگارندگان با روشی توصیفی تحلیلی ضمن معرفی اصول انگلیسی حاکم بر حفاظت از میراث انگلیسی و مطابقت‌سنجی آن اصول در نظام حقوقی ایران، به تبیین نهادهای حافظ میراث فرهنگی غیر منقول و حدود صلاحیت آنها در دو کشور انگلیس و ایران پرداخته‌اند.}, keywords_fa = {اثر تاریخی,اثر فرهنگی‌,حفاظت از میراث فرهنگی,حقوق انگلستان,میراث فرهنگی غیر منقول}, url = {https://www.malr.ir/article_253194.html}, eprint = {https://www.malr.ir/article_253194_2c0d4b0dd23e6f8978ad457917415923.pdf} }
