Because the unconditional protection of public order by the government makes it possible for citizens to abuse and unconditionally exercise the freedom of assembly and march, there is a possibility of chaos. Therefore, in this article, an attempt has been made to examine the legal system governing the issue and to examine the approach of the Court of Administrative Justice of Iran. How the government and public officials (administrative police) can protect the public order by preventing a peaceful, non-criminal rally from violent demonstrations, riots and even uprisings against the government is a major issue. The results of the research show that the Court of Administrative Justice in organizing the relationship between public order and freedom of association not only does not have a clear and definite approach, but also has a paradoxical and contradictory approach. For example, the General Assembly of the Court of Administrative Justice considered the government's decision to designate places for rallies to restrict freedom of assembly, but on the contrary, the need to obtain a permit to march, despite the fact that Article 27 of the Constitution includes restrictions on Freedom of assembly is not mentioned, it does not limit the freedom of assembly.}, keywords = {Public Order,Freedom of Assembly,Public Officials,Administrative Police,Administrative Justice Court}, title_fa = {نظام حقوقی حاکم بر پاسداشت نظم عمومی و تضمین آزادی اجتماعات (با تاکید بر رویکرد دیوان عدالت اداری)}, abstract_fa = {ساماندهی رابطه میان نظم عمومی و آزادی اجتماعات از چالش برانگیزترین گفتمان های حقوق اداری است. چه آنکه پاسداشت بدون ضابطهِ نظم عمومی از سوی دولت، امکان سوء استفاده و اِعمال بی قید و شرطِ آزادی اجتماعات و راهپیمایی ها از سوی شهروندان احتمال هرج و مرج را به دنبال دارد. لذا در این نوشتار کوشش شده است ضمن بیان نظام حقوقی حاکم بر موضوع، رویکرد دیوان عدالت اداری ایران مورد بررسی قرار گیرد. اینکه دولت و مقامات عمومی (پلیس اداری) چگونه می توانند ضمن پاسداشت نظم عمومی از مبدل شدن یک تجمع مسالمت آمیز و فاقد وصف مجرمانه به یک تظاهرات خشونت آمیز، شورش و حتی قیام علیه حکومت جلوگیری نماید، مسئله اصلی مقاله است.نتایج پژوهش بیانگر آن است که دیوان عدالت اداری در ساماندهی رابطه میان نظم عمومی و آزادی اجتماعات نه تنها رویکرد روشن و مشخصی ندارد بلکه دچار رویه ای پارادوکسیکال و متناقض نما گشته است. برای نمونه هیات عمومی دیوان عدالت اداری، اقدام دولت در تعیین مکان هایی مشخص برای برگزاری تجمع را تحدید کننده آزادی تجمع تلقی اما بر عکس، لزوم اخذ مجوز برای راهپیمایی را به رغم اینکه در اصل بیست و هفتم قانون اساسی از جمله محدودیت های وارده بر آزادی تجمع ذکر نشده است، تحدید کننده آزادی اجتماعات نمی‌داند.}, keywords_fa = {«نظم عمومی»,«آزادی اجتماعات»,«مقامات عمومی»,«پلیس اداری«,«دیوان عدالت اداری»}, url = {https://www.malr.ir/article_43286.html}, eprint = {https://www.malr.ir/article_43286_e964c221561bf5fe12c5ef8a88b8e8cb.pdf} }
