Abstract
Prevention of damage is one of the new approaches in civil responsibility. Based on the preventive approach, civil liability in various fields tends to prevent damage from occurring instead of waiting for damage to occur, and instead of looking backward and looking at the past like traditional civil liability, in the new approach, it is based on It is forward-looking and aims to prevent the occurrence or continuation of damage in the future. Therefore, in this study, using the descriptive-analytical method and the use of valid legal sources, it examines the implementation of the system of preventive civil responsibility of the government in Iran. Basically, civil liability of the government is one of the new issues in Iranian administrative law, and the acceptance of preventive civil liability for the government also faces shortcomings in terms of existing regulations. The results of the survey show that by observing some of the basic principles of preventive civil liability, there is still a suitable space for the full realization of this new approach, which can illuminate the limited boundaries of traditional civil liability and while preventing more serious damage. also prevent Of course, the recognition of preventive civil responsibility of the government requires the amendment of the existing laws.
