چکیده
ورود فناوری‌های نوین به عرصه حکمرانی، ساختار نظارت اداری را به‌طور بنیادین دگرگون کرده است. در نظام‌های اداری مبتنی بر حکمرانی الکترونیک، ابزارهای دیجیتال نقش مهمی در تسهیل نظارت بر عملکرد کارکنان و ارتقای سطح پاسخ‌گویی نهادها ایفا می‌کنند. با این حال، ترک وظیفه نظارتی از سوی کارمندان دولت در چنین بسترهایی، صرفاً یک خلأ عملکردی نیست؛ بلکه می‌تواند زمینه‌ساز اختلال در اجرای عدالت اداری و حتی بروز فساد سازمان‌یافته و خسارات گسترده عمومی گردد. در این میان، پرسشی اساسی مطرح می‌شود: آیا ترک وظیفه نظارتی در چارچوب نظام‌های الکترونیکی، نیازمند جرم‌انگاری مستقل است و باید به‌عنوان رفتاری قابل تعقیب کیفری شناخته شود یا خیر؟ مقاله حاضر با هدف تبیین مبانی حقوقی جرم‌انگاری این نوع ترک وظیفه در بستر فناوری‌های نوین، به بررسی ضرورت یا عدم ضرورت وضع قوانین کیفری جدید در این زمینه می‌پردازد. روش تحقیق در این مطالعه توصیفی-تحلیلی است و بر تحلیل اسناد قانونی، بررسی رویه قضایی، و مطالعه تطبیقی با تجارب کشورهای دیگر در حوزه حکمرانی دیجیتال استوار است. یافته‌های پژوهش نشان می‌دهد که تغییر ماهیت نظارت در بسترهای الکترونیکی، خلأهایی جدی در ساختار کیفری فعلی پدید آورده است؛ به‌گونه‌ای که در بسیاری موارد، ترک وظیفه نظارتی از شمول مؤثر ضمانت‌های قانونی خارج شده و به‌دلیل نبود صراحت قانونی و عدم تطابق ابزارهای سنتی با الزامات فناوری‌محور، امکان گریز از پاسخ‌گویی را برای کارکنان فراهم می‌سازد. بر این اساس، دستیابی به حکمرانی الکترونیک کارآمد، نیازمند بازنگری در سیاست جنایی تقنینی است. جرم‌انگاری هدفمند ترک وظیفه نظارتی، با در نظر گرفتن مقتضیات و شاخص‌های فناوری‌محور، می‌تواند

چکیده English

The introduction of new technologies into the field of governance has fundamentally transformed the structure of administrative oversight. In administrative systems based on e-governance, digital tools play an important role in facilitating oversight of employee performance and improving the level of accountability of institutions. However, the abandonment of supervisory duties by government employees in such contexts is not simply a functional vacuum; it can also lead to disruption in the implementation of administrative justice and even the emergence of organized corruption and widespread public losses. In the meantime, a fundamental question arises: does the abandonment of supervisory duties within the framework of electronic systems require independent criminalization and should it be recognized as a behavior subject to criminal prosecution? The present article, with the aim of explaining the legal foundations of the criminalization of this type of abandonment of duties in the context of new technologies, examines the necessity or non-necessity of establishing new criminal laws in this field. The research method in this study is descriptive-analytical and is based on the analysis of legal documents, the examination of judicial practice, and a comparative study with the experiences of other countries in the field of digital governance.
