آسیب‌شناسی نهادهای حقوقی حمایت از تولید؛ قواعد و سازوکارهای اجرایی

چکیده
نهادهای حقوقی معادل قواعد و سازوکارهای اجرایی، در عملکرد اقتصادی دولت‌ها نقش موثری ایفا می‌کنند. از ابتدای دهه نود، حمایت از تولید ملی یکی از مهم‌ترین مسائل کشور در پیشبرد اهداف اقتصادی بوده که موضوع سیاست‌های کلی قرار گرفته‌است. در راستای اعمال این سیاست‌ها، نظام حقوقی به وضع قواعد حقوقی و ایجاد نهادهای دولتی پرداخته-است. با توجه به عدم موفقیت در دستیابی به هدف مذکور، بررسی و آسیب‌شناسی نهادهای حقوقی حمایت از تولید می‌تواند در بهبود عملکرد دولت در ارتقا و رشد تولید ملی مفید باشد. با بررسی صورت‌گرفته در سه سطح سیاستگذاری، قانونگذاری و اجرا با چالش‌هایی مواجه هستیم که توجه به آنها و حل چالش‌ها موجب تحقق سیاست‌های کلی می‌شود. عدم وجود نگرش واحد در سیاست‌های حمایت از تولید، عدم توجه به کیفیت قانونگذاری و فقدان دیوان‌سالاری توانمند از جمله آسیب‌های موجود در نهادهای حقوقی است. تدوین سند توسعه صنعتی و رعایت ملزومات نهادی، اعمال ارزیابی تاثیرات قانون و توجه به ویژگی‌های دیوان‌سالاری که شامل تمرکز نهادی و پاسخگویی نهادها می‌شود، راهکارهای پیشنهادی در راستای دستیابی به نظام حقوقی موثر در عملکرد اقتصادی دولت است.

چکیده English

Legal institutions equivalent to rules and their enforcement characteristics play an effective role in the economic performance of governments. Since the beginning of the nineties, supporting the national production has been one of the most important issues of the country in advancing economic goals, which has become the subject of general policies. To apply these policies, the legal system has established legal rules and established government institutions. Considering the lack of success in achieving the mentioned goal, the investigation and pathology of the legal institutions supporting the production can be useful in improving the performance of the government in the promotion and growth of the national production. With the investigation carried out at the three levels of policy making, legislation and implementation, we are facing challenges that paying attention to them and solving the challenges will lead to the realization of general policies. The lack of a single attitude in production support policies, lack of attention to the quality of legislation, and the lack of a capable bureaucracy are among the damages in legal institutions. Compiling the industrial policy document and complying with the institutional requirements, applying regulatory impact assessment and paying attention to the characteristics of the bureaucracy, which includes the institutional focus and the accountability of the institutions, are the suggested solutions in order to achieve an effective legal system in the economic performance of the government.
