تحلیل درهم تنیده حقوق کار زنان قالیباف( مطالعه موردی بیمه زنان قالیباف تبریز)

چکیده

زنان بخش اعظمی از جمعیت قالیبافان در ایران را تشکیل می‌دهندکه غالبا در خانه و بدون کارفرما مشغول قالیبافی بوده و از بیمه اجتماعی اجباری محروم هستند. قانون بیمه قالیبافی مصوب 1388 فرصت برخورداری از بیمه اجتماعی را به آنها داد اما در این مقاله، یک گروه از زنان قالیباف حاشیه‌نشین تبریز مورد مطالعه قرار می‌گیردکه علیرغم اشتغال تمام وقت، نتوانستند از حمایت قانونگذار برخوردارشوند. چرایی و چگونگی عدم دسترسی این زنان به بیمه قالیبافی، پرسش اصلی مقاله است. برای جمع‌آوری داده، از روش کیفی و تکنیک مصاحبه‌های عمیق نیمه‌‌ساختاریافته استفاده شده‌است. تحلیل داده‌ها با روش تحلیل مضمون در چارچوب نظری درهم‌تنیدگی نشان می‌دهد که روابط و موقعیت نابرابر بین فردی و درون‌گروهی، موانع ساختاری، توجیه‌های فرهنگی و عقیدتی و حوزه تنظیم‌گری انظباطی و اداری در ارتباط با یکدیگر منجر به محرومیت این زنان از حقوق کار شده است. شناسایی حقوقی همه قالیبافان به عنوان یک گروه مشابه و واحد بدون در نظر گرفتن تفاوت‌ های‌آنها منجر به دسترسی نابرابر به این قانون شده است. این گروه از زنان قالیباف نه‌تنها به خاطر جنسیت خود، بلکه در وضعیت درهم تنیده با محل زندگی، طبقه اقتصادی و اجتماعی و سن در یک موقعیت درحاشیه قرارگرفته‌اند. نظام حقوق کار با تعریف مضیق از کارگر، زنان قالیباف خانگی را به عنوان کارگر به رسمیت نشناخته و سازوکار مناسب برای تضمین دسترسی آنها به حقوق کار ازجمله تامین اجتماعی پیش‌بینی نکرده‌است. نهایتا، باتوجه به موقعیت درهم‌تنیده قالیبافان، نظام جایگزین بیمه قالیبافی پیشنهاد می‌شود که چندلایه و چندبعدی، منعطف و دارای سطح‌بندی باشد.

Women constitute a large part of the Iranian carpet weaving population, who usually weave carpets at home without an employer and are deprived of compulsory social insurance. The carpet weaving insurance law passed in 2009 gave them the opportunity to use social insurance, but a group of women carpet weavers from the suburbs of Tabriz is being studied who, despite their full-time employment, could not enjoy it. Why not having access to the law is the main question. Qualitative methods and semi-structured in-depth interviews were used to collect data. Data analysis with the thematic method in the intersectional theoretical framework shows that unequal interpersonal and in-group relationships, structural barriers, cultural and ideological justifications, and the disciplinary and administrative regulation in relation to each other have led to the deprivation of these women from labor rights. Women carpet weavers are marginalized not only because of their gender, but also because of their intertwined status with their location, economic-social class, and age, which even the Iranian legal system seeks to enact laws and regulation to support them, it is not available. The labor law system, with its narrow definition of worker, does not recognize women carpet weavers as workers and does not provide an appropriate mechanism to ensure their access to labor rights. The authors conclude that the persistence of social inequalities even with the enactment of some protected laws by the legal system, such as carpet weavers' insurance will be better understood by the method of intersectional analysis.
