The participation of NGOs in the criminal and administrative process signifies their willingness to build public trust in the justice system. Therefore, in order to combat and prevent crimes, considering the influential role of NGOs, it can be said that the criminal justice system can benefit from the capacities of civil institutions. The main question is to what extent the Clean Air Act has utilized the participation of these organizations, given the importance and role of NGOs. Then, by enumerating and distinguishing the participatory criminal policies envisaged in the Clean Air Act, the role of these policies in addressing air pollution is examined. In the end, by identifying the entities involved in the air pollution problem, it is concluded that unfortunately, the legislator only pays attention to government organizations in the implementation of participatory policies, and there is no apparent impact of NGOs' participation. This is while the majority of environmental protection responsibilities are placed under the supervision of the environmental protection agency, which structurally lacks the strength compared to similar organizations in other countries to effectively exercise its supervisory role. Therefore, fundamental structural changes are required in this regard. It can be said that in order to achieve clean air, the executive mechanisms envisaged in the Clean Air Act alone are not sufficient and it will require structural reform alongside the participation of NGOs.
